1. Processing of personal data

 

In addition to the provisions set out in other pages (in particular "Cookies"), through the Website and the use of the corresponding functions and/or subscription services offered therein, the following data may be collected and processed:

 

Browsing information: data automatically collected by the server on each visit to the Website, such as the IP address or domain name of the computer used by the user to connect to the Website, the URI address (Uniform Resource Identifier) of the requested resource, the time of the request, the method used to submit the request to the server, the size of the file obtained as an answer, the code number indicating the status of the answer provided by the server (i.e. good result, error, etc.) and other parameters related to the operating system and the IT environment of the user. Included within this scope are "social buttons", which only allow linking and viewing the social profiles of the brand "ASTELLAN Fragrances Ltd".

These are the data provided by the user by filling in electronic forms for registration and account creation on the Website, submitting a purchase order and/or making a request for information, such as name, surname, date of birth, e-mail address, address, telephone number (also mobile number) and additional data or information contained in messages sent to the contacts indicated on the Website, or by filling in forms published on the Website and for the purpose of subscribing to specific services (such as creating a "wish list" or subscribing to a newsletter service). Data related to the order and purchase process fall within the scope of this category.

2. Legal basis and purpose of processing

 

The processing of personal data is based on the consent voluntarily provided by the User when filling in the dedicated forms published on the Website and in the specific sections where personal data is collected, on the basis of the existence of a contractual or legal obligation or, depending on the case and as provided in more detail below, on the legitimate interests of the Company and solely for the following purposes:
Fulfillment of contractual or pre-contractual obligations - Registration on the Website (and creation of an account) and the proper execution of other services requested through the Website and/or through the electronic forms published here, therefore, for the management and processing of product orders placed through the Website and for the performance of all obligations arising from the pre-contractual or contractual relationship with the User. Administrative and accounting purposes related to and arising from the contract concluded with the User, also including those concerning the electronic transmission of order confirmations, invoices and communications regarding the delivery of the order by ASTELLAN Fragrances Ltd or other companies designated by it, as well as those related to the management of discounts, promotional sales and promotions fall within the scope of this purpose. The services provided by the Customer Service, and therefore the processing of the User's personal data for the management and response to requests for assistance related to one or more products or services offered on the Website, are included within the scope of the contract for data processing.
Fulfillment of legal obligations - fulfillment of obligations arising from current national and/or European laws or regulations, including in the areas of taxation and cosmetic vigilance, as well as compliance with regulations of competent entities or authorities.
Based on the legitimate interests of the Company - for the legal defence of rights or interests before any competent authority or entity (even against cybercrime and for credit recovery); to improve the service and browsing experience; to perform statistical analysis and market research on aggregated data; to send the customer communications by e-mail containing information about products or services similar to those offered by ASTELLAN Fragrances Ltd, unless the customer objects to such data processing (so-called soft spam).
On the basis of consent (voluntary and revocable at any time): sending newsletters and advertising material related to ASTELLAN Fragrances Ltd products and/or services by automated systems such as e-mail, SMS or MMS or by traditional means (paper mail) (so-called marketing purposes) and/or processing the commercial profile of users or customers by detecting and processing their choices and purchasing habits on the Website in order to monitor customer satisfaction and ensure better response to customer needs and to send advertising material related to ASTELLAN Fragrances Ltd products and/or services of particular interest (so-called profiling purposes).
We inform you that profiling is carried out through the collection and processing of personal and/or identifiable data (personal data, contact data) and its association or cross-reference with interests or consumer preferences or other macro indicators, such as geographical distribution, age group, gender (male or female).

 

Profiling may also be based on aggregated data derived from personal data. However, even when used in aggregated form, it cannot be excluded that the data used for this purpose enable the identification of the data subject.

3. Consequences of refusal to provide data

 

Providing data for the purposes set out in clauses (i) (fulfillment of contractual obligations) and (ii) (fulfillment of legal obligations) above is purely voluntary. However, since the processing of such data is necessary for browsing the Website and for the use of the online services offered through it, the provision of missing, partial or incorrect data will, as the case may be, result in the impossibility of registering on the Website, the management and processing of orders and/or the use of the online services, as well as, in general, the impossibility of processing specific requests from the User.
For point (iii) (ASTELLAN Fragrances Ltd’s legitimate interests), the user’s explicit consent is not required, but it is always possible to object to such processing by exercising the data subject rights set out in clause 10 below.

 

Providing data and consent for the purposes set out in point (iv) (direct marketing and profiling) is optional. However, if the customer does not consent to the processing of data for the above additional purposes, the customer will not be able to benefit from personalized discounts and exclusive offers, nor receive promotional information by direct communication.

 

In any case, the customer/user may withdraw their consent for marketing and/or profiling purposes at any time in accordance with the procedure set out in clause 10 below.

 

It is understood that any subsequent withdrawal of consent will not affect the lawfulness of the processing of data carried out before the withdrawal.

4. Data Communication

 

The data may be communicated to the following categories of subjects:

 

All parties (including public authorities) who have access to the personal data by legal or administrative provisions;

 

To all public and/or private parties, individuals and/or legal entities, if the communication is necessary for the proper performance of a contractual or legal obligation or is otherwise required.

 

In addition to the above, and in order to achieve the above purposes, the personal data may be disclosed to third parties operating on behalf of the Company, such as, but not limited to:

 

Companies, consultants or professionals responsible for the setup, maintenance, updating and general management of the hardware and software of the Website;

5. Data Retention

Personal data processed for marketing and profiling purposes will be retained until the client/user withdraws consent.

6. Rights of the data subject

 

As a data subject, the user can ask the data controller to exercise the following rights:

Right of access

 

Users can ask whether their personal data is processed and, if so, access it as well as specific information about the processing, such as the purpose of the processing, the categories of personal data concerned, and other rights described below. Users can also request a copy of their personal data.

Right to rectification

 

Users have the right to request rectification of their data if it is inaccurate or incomplete.

Right to erasure

 

Users have the right to have their data deleted without undue delay if: (i) such data are no longer necessary for the purpose for which they were originally collected, (ii) the user objects to the processing of their personal data (as indicated below) and there are no other legitimate and prevailing grounds for processing, (iii) the user's data has been unlawfully processed, (iv) the data must be deleted to comply with a statutory obligation.
The right to erasure does not apply if processing is necessary for the compliance with a legal obligation or for the establishment, exercise or defence of legal claims.

Right to limit processing

 

Users have the right to obtain the right to limit processing, which means that the processing activities will be suspended for a certain period of time. The circumstances in which this right is exercised include when the accuracy of the personal data is contested but a period of time is required to verify its accuracy. The exercise of this right does not prevent the processing of personal data.

Right to data portability

 

If the processing is carried out by automated means, based on consent or in fulfillment of a contractual obligation, the User has the right to request to receive the personal data in a structured, commonly used and machine-readable format and to transmit the data to another data controller. Where technically feasible, the User also has the right to request that the data be transmitted directly from one data controller to another, without prejudice to the deletion of the data as described above.

Right to object

 

Users have the right to object at any time to processing of their data based on their own situation, based on the legitimate interests of the data controller, unless the data controller can demonstrate a legitimate and compelling basis for the processing, which is in line with the interests, rights and fundamental freedoms of the data subject, or the data are necessary for the establishment, exercise or defence of legal claims. In addition, users have the right to object to processing of their data for marketing purposes.
Please note that consent for marketing purposes applies to both automated tools and traditional communication methods (paper mail). Objection to the processing of personal data for marketing activities carried out by automated tools also applies to traditional communication methods. The data subject can object to the aforementioned processing at any time, in part, e.g. to marketing activities carried out solely by automated tools.

This Privacy Policy may be modified and updated in accordance with changes in the applicable legal provisions.
